We want to make sure you have a safe and clear experience, so we invite you to read these Terms and Conditions (the "Terms"), which govern your use of our website https://www.findie.global/ (the "Site").
Findie SpA is a joint stock company incorporated under the laws of the Republic of Chile, with tax number 77.311.341-6 (hereinafter, "Findie" or the "Company"). Our mission is to promote Latin American creative talent by connecting it with opportunities around the world through our website.
These Terms govern your general use of the Site, as well as certain additional applications, features and services that may be offered in the future. In some cases, there may be specific rules that supplement or elaborate on what is set forth herein.
To become a user of Findie, you must be 18 years of age or older and agree to these Terms. Throughout this document, we will refer to any person who visits the Site and uses its services as the User. Simply browsing the Site does not create any obligation for the User. However, by registering or using our services, you expressly and bindingly agree to these Terms.
At Findie, we are committed to providing our services to Registered Users in accordance with these Terms. The use of the Site, as well as any interaction, contract or transaction made through it, shall be governed by the laws of the Republic of Chile. In particular, Law No. 19.496 on Consumer Rights Protection and the Electronic Commerce Regulations shall apply, together with any other applicable regulations in force.
Access to and use of Findie is reserved exclusively for: ● Natural or legal persons of legal age who have the legal capacity to enter into contracts. ● Users who comply with applicable laws and have no legal restrictions to use these services. The following may not access or use Findie: ● Those who have been previously suspended or blocked by the Site due to breaches of these Terms. ● Persons who are prohibited by law from using these types of services.
At Findie, Users can access free of charge the Site and mobile applications that allow them to browse, explore, compare and, if they wish, purchase services available on the Site.
To access certain services, Users may register and create an account on the Site (hereinafter, the "Account"). To do so, they must provide true, accurate, current and complete information as required in the registration process: ● All information provided will be treated in accordance with our Data Protection Policy. ● Findie may request updates or additional information to ensure the accuracy of the data. ● Each User is responsible for protecting his or her credentials and not sharing his or her account with third parties, except as permitted under certain Site modalities. The ownership of the account is based on the information provided during registration, so it is essential that the User keeps his or her information updated and accurate.
Users are the owners of the information they enter on Findie, either during registration or when interacting with the Site. Therefore:Each User is responsible for the truthfulness and accuracy of the data he or she provides. If you share information that belongs to third parties, you must have the necessary permissions or authorizations before publishing it.
By using Findie, Users authorize the use of information provided or generated within the Site. This authorization is granted with the acceptance of these Terms and our Data Processing Policy. The information Users enter or generate on Findie may be used to: ● Improve the Site and its services, optimizing the experience of Users and related companies. ● Develop statistics on Users' behavior to provide personalized recommendations. ● Optimize suggestions for both consumers and providers within the Site. ● Conduct business analysis to improve market performance, including in areas where Findie is not directly involved. ● Send commercial and advertising content, always aligned with the interests of Users. If at any time you wish to modify, delete or receive information about the data you have provided, you can do so by sending an email to legal@findie.global.
Users may communicate with Findie through the channels provided on the website or by sending an email to contacto@findie.global. These are the only official means of dealing with queries, suggestions or requests related to the use of the Site. The Site is not obliged to monitor or supervise the use made by Users of these communication channels. However, in the event that improper use is detected, Findie reserves the right to terminate the account of the User who has violated the rules or made inappropriate use of these means, and Findie is not obligated to communicate with Users by means other than those mentioned herein. Any attempt to contact by unofficial means shall not create any liability or obligation for Findie to respond.
Findie may include links directing Users to third-party websites, applications or platforms. These links may be present for various purposes, such as providing additional information, facilitating connections to other services, or forming part of the Website's advertising and marketing strategies. However, Findie does not control and is not responsible for the content, operation or security of these external sites. Access to any page or application outside the Site is the sole responsibility of the User. Therefore, it is recommended that you review the terms and conditions, privacy policies and other legal documents of external sites or applications before interacting with them.
Users are obligated to maintain the privacy and security of their Account at all times. It is strictly forbidden to share access credentials with third parties. If a User allows another person to use his or her Account without proper authorization within the permissions provided on the Site, he or she will be liable for any consequences resulting from such use. Findie assumes no responsibility for any damages that the Account holder may suffer due to misuse by third parties to whom he/she has granted access. If a User suspects that his or her Account or credentials have been compromised or used without his or her authorization, he or she should immediately contact Findie through the official communication channels. Failure to do so will result in Findie assuming no liability for the use of the Account and the User will be fully responsible for any activity performed on the Account.
You must use your Account in strict compliance with national and international regulations and public order. In particular, but without limitation, you shall not: ● Access the Site, the Accounts and/or the Services through any means other than the interfaces themselves provided by the Site or those means that are expressly authorized in these Terms; ● Bypass, circumvent, remove, disable, disable, impair, decode or otherwise alter security measures, usage regulations or any other protective measures implemented by Findie, service providers or any third party to protect the Site, the Accounts or the Services. In particular, you may not do any of the foregoing to alter functionality that is restricted or only available to certain Account types; ● Access, tamper with or use private areas of the Site or Service, the computer systems therein, or the technical systems of our suppliers; Use metatags or other hidden text or metadata on the Site or the Services, as well as manipulate headers or other identifiers in order to disguise the origin of the content transmitted through Findie; ● Use, display, reproduce, modify or alter the contents of the Site or the Services in any way that may be considered 'sensitive' or 'special' under Chilean data protection regulations or that refers to payment data without our prior written consent; ● Use metatags or other hidden text or metadata on the Site or the Services, as well as manipulate headers or other identifiers in order to disguise the origin of the content transmitted through Findie; ● Use, display, mirror or frame the Site or the Services, and any elements of the Site or the Service, the look and feel or any part of the Service or the Site, or the intellectual property or other proprietary rights of The Company; ● Attempt to access or search the Service or the Site, or perform scraping or downloading techniques on the content of the Service or the Site, or otherwise use, upload content to, or create new links, republishing, or references on the Services or the Site through the use of an engine, software, tool, agent, device or mechanism (including automated scripts, spiders, robots, crawlers, data mining tools or the like) other than the software and/or search agents that have been provided, or others generally available in search engines offered by third parties; ● Reverse engineer, decompile or disassemble (disassemble) software used in connection with the Site; ● Interfere with, or attempt to interfere with, the access of any user, host or network, including, without limitation, sending viruses, overloading, flooding, spamming, or email-bombing the Services or the Site; ● Reproduce, duplicate, copy, sell, trade, resell or exploit for a commercial purpose any section of the Site, or your access to or use of the Findie Site, ● Impersonate or mislead as to your affiliation with any person or company, as well as harass or stalk other users or third parties, or use or share offensive or pornographic content; ● Engage in activities such as vulnerability scans, load testing, penetration testing or circumventing security measures, absent our prior written approval; ● Send unsolicited or unauthorized electronic commercial communications, chain letters or other forms of unsolicited solicitation for services, whether through the channels on the Site or other means; and/or ● Otherwise use the Account or the Site in a manner contrary to Findie's legitimate rights and interests of any third party, or in any manner that may disrupt, interrupt, overburden or otherwise damage the Site.
Registered Users may only use the Website or its services in interoperation or communication with other software, where authorized by the Company or where such integration has been developed using public APIs and other related products and services provided by Findie as part of its range of technology products for developers and integrators. Notwithstanding that such use is subject to its own Terms and Services.
Findie undertakes to use its best efforts to maintain the optimal operation of the Site and to ensure the availability of its services in accordance with the conditions offered to Registered Users. However, there may be exceptional situations, such as force majeure events or other factors beyond Findie's control, that prevent or affect the normal provision of services. In such cases, Findie shall not be liable for interruptions or failures beyond its ability to manage.
Findie undertakes to provide a timely response to Users' queries through the communication channels provided. The service will be provided to the best of its ability, seeking to provide appropriate solutions to each request. However, the availability of response may vary depending on the nature of the query, the volume of requests and the resources available at any given time.
Findie has the right to eliminate, suspend or condition any type of Account, regardless of its Owner and without requiring prior authorization or notice to the latter, when the Registered User has breached these Terms or has engaged in conduct contrary to the essence of the same or that causes harm to Findie, the Site or other Users. It may also reserve the right to deny registration of Accounts, as well as to deny navigation on the Site, in cases where it is necessary to preserve the well-being of the Site and its Users.
Findie reserves the right to suspend, close or condition the Account of any Registered User if it detects that he or she has breached these Terms. This includes, but is not limited to: ● Providing false, inconsistent or outdated information required by the Site. ● Failure to provide permissions for the use of third party information. ● Violation of intellectual property rights of Findie, other Users or any affected third party. ● In the event of account suspension or closure, Findie may notify the User giving the User an opportunity to cure or clarify the situation if it can be corrected. In such cases, a period of not less than 5 business days will be established for the User to regularize the situation. However, no deadline will be granted if the fault committed has caused damage to the Company, the Site or third parties, in which case Findie may close the account definitively and immediately.
All Registered Users may at any time close their account and terminate the services obtained from the Site, with no other protocol than to perform the closing process enabled through their Account. Once the account is closed, you will lose the data associated with it and in case of a subsequent activation of the Account, Findie is not obliged to perform any management for the recovery of this data. The User agrees that he/she is solely responsible for logging into his/her account and proceeding with the suspension or deletion of his/her account should he/she wish to suspend or terminate the services. Likewise, the User acknowledges and accepts that until the account is deleted, it may continue to be reviewed by any person who has access to it.
The user acknowledges and agrees that the site makes no warranties, either express or implied, with respect to the accuracy, completeness, quality or availability of the data, content, information and services provided on the Site. Unless otherwise expressly and exclusively provided by law to the extent and extent set forth, the Site does not warrant or assume any liability for any damages or losses arising from the use of the information, data and services offered on the Site. In no event shall the Site be liable for any damages or losses that may arise due to information and/or services provided by third parties not belonging to the Company. All liability shall be borne by such third parties, whether they are suppliers or collaborators.
To accept these Terms and Conditions, the User must click where the Website offers this option in the User interface to give unequivocal consent to acceptance. Findie reserves the right to modify, update or amend these Terms and Conditions at any time and without prior notice. Amendments will be posted on the official website and will be effective as of the date of posting. Continued use of the services after the publication of the modifications will be understood as express acceptance of the new terms.
The Parties agree that the illegality, invalidity, nullity or unenforceability of any section of these Terms shall not affect the validity of the remaining provisions of these Terms, which shall remain in full force and effect. Such sections shall be replaced or integrated with other sections that, as provided by law, correspond to the purpose of the replaced sections. Failure to enforce any of the provisions of these Terms shall not constitute a waiver by User or Findie of any subsequent or similar breach or failure to enforce any provision of these Terms. Any waiver must be in writing and signed by a representative of The Company in order to be fully valid. These Terms constitute the entire agreement with The Company with respect to the Account and Service provided to any User. The Parties warrant that, in entering into this Agreement, no promises in addition to those contained herein have been made. Furthermore, if there are additional agreements entered into by the Parties, they agree that those agreements shall take precedence over these Terms, provided that they are in writing and have the acceptance of both Parties. The rights and obligations set forth in these Terms or with respect to the Account and the services in question may only be assigned to a third party with the prior written consent of the Website.
In addition to the communication channels mentioned in these Terms, Users may contact Findie for legal or Site-related inquiries at the following email address: Legal@findie.global. This will be the official channel for addressing concerns related to legal issues or any other matter related to the application of these Terms.
These Terms are governed by and construed in accordance with Chilean law, without prejudice to the rules of an international nature that may apply in addition to the application and interpretation, provided that they are accepted, recognized and enforced by the Chilean State, without giving effect to its conflict of law provisions. Any dispute that may arise in connection with or related to the Site or The Company, its Site or its Services shall be submitted to the courts of the city of Santiago, Chile and in its absence and if Findie approves it, to arbitration in the city of Santiago in charge of the Santiago Chamber of Commerce (CCS) or the institution that replaces it or takes its place, in case it ceases to exist. The Intellectual Property Law No. 17.336 and its complementary regulations; Consumer Protection Law No. 19.496 and its complementary regulations, including the Electronic Commerce Regulations; Privacy Protection Law No. 19.628 and its complementary regulations; as well as the main rules of law contained in the Chilean Civil Code and other rules relevant to these Terms have been taken into account in the drafting of these Terms.
